Welcome to www.onealforpa.com (the "Site"), operated by O'Neal for PA (the "Committee," "we," "us," or "our"). By accessing or using the Site, making a contribution, signing up to volunteer, or opting in to receive communications from us, you agree to these Terms and Conditions ("Terms"). If you do not agree, please do not use the Site.

1. Eligibility

The Site and our programs are intended for individuals who are at least 18 years old or otherwise eligible under applicable law to make political contributions or engage in campaign activity. By using the Site, you represent that you meet this requirement.

2. Political Contributions

  • Contributions to O'Neal for PA are subject to applicable federal and/or Pennsylvania campaign finance laws, including contribution limits and source restrictions.

  • By making a contribution, you certify that: (a) you are a United States citizen or lawfully admitted permanent resident; (b) the funds are your own and are not being provided by another person or entity in your name; (c) you are not a foreign national, federal government contractor, or otherwise prohibited from contributing under applicable law; and (d) the contribution does not exceed applicable legal limits, considering your contributions to this Committee during the applicable election cycle.

  • We are required to use best efforts to collect and report the name, mailing address, occupation, and employer of contributors as required by law.

  • All contributions are non-refundable except as required by law or at the Committee's discretion.

  • Contributions are not tax-deductible as charitable donations.

3. Text Messaging and Communications Program

By providing your phone number, email address, or mailing address and opting in, you consent to receive communications from O'Neal for PA, including fundraising appeals, get-out-the-vote reminders, volunteer requests, and campaign updates, by text message, email, phone, or mail. Consent to receive messages is not a condition of any contribution or service. Text messaging is also governed by the terms in our Privacy Policy, including STOP/HELP opt-out instructions. These Terms incorporate our Privacy Policy by reference.

Mobile Messaging Program Consent

By signing up for our Mobile Messaging Program, you consent to receive the following types of text messages from O'Neal for PA:

  • Polling/Voting Text Messages: Such as election reminders and opinion polls.

  • Public Service Announcement Text Messages: Including legislative updates, member updates, and voter education.

Opt-In Methods

  • Completing a sign-up form on our website and checking the text message consent box.

  • Providing explicit consent in any other manner as indicated by O'Neal for PA.

Message Terms

  • Messages may be sent using an autodialer or similar technology.

  • Message frequency may vary depending on your interaction with the Program.

  • Standard message and data rates may apply.

  • Wireless carriers are not liable for delayed or undelivered messages.

4. Acceptable Use

You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms

  • Submit false, misleading, or fraudulent information, including false contributor information

  • Attempt to gain unauthorized access to the Site, our servers, or any connected systems

  • Interfere with or disrupt the operation of the Site, including through viruses, bots, or other harmful code

  • Scrape, harvest, or collect information about other users or visitors

  • Impersonate any person or entity or misrepresent your affiliation with any person or entity

  • Use the Site to transmit spam, chain letters, or unsolicited commercial communications

5. Intellectual Property

All content on the Site, including text, graphics, logos, images, campaign branding, and software, is the property of the Committee or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from Site content without our prior written consent, except for personal, non-commercial use or as permitted by law (e.g., sharing a link to the Site).

6. Third-Party Services and Links

The Site may use third-party services for payment processing, email delivery, text messaging, and analytics, and may link to third-party websites, including social media platforms. We do not control and are not responsible for the content, policies, or practices of third-party sites or services. Your use of those services is subject to their own terms and privacy policies.

7. Disclaimers

The Site and its content are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that any defects will be corrected.

8. Limitation of Liability

To the fullest extent permitted by law, the Committee, its officers, staff, volunteers, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or goodwill, arising out of or related to your use of the Site or these Terms, even if advised of the possibility of such damages. Our total liability for any claim arising from these Terms or your use of the Site shall not exceed the amount, if any, you paid to us in the twelve months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless the Committee and its officers, staff, volunteers, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your violation of any law or third-party right.

10. Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws principles. Any dispute arising under these Terms shall be brought exclusively in the state or federal courts located in Pennsylvania, and you consent to the personal jurisdiction of those courts.

11. Changes to These Terms

We may revise these Terms at any time. The "Effective Date" above reflects the date of the most recent revision. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
